EYES UP! by Last Call Initiative — Terms of Service
These Terms of Service govern purchases made through the EYES UP! online store operated by Last Call Initiative (“LCI,” “we,” “us,” or “our”). By using this store or placing an order, you agree to these terms.
1. Products and Pre-Orders
Certain products, including the EYES UP Magnetic Phone Mount Founding Batch, may be offered for pre-order before inventory is received or available for immediate shipment.
By placing a pre-order, you acknowledge that the product will not ship immediately and that production, procurement, and fulfillment timelines may change.
We will make reasonable efforts to keep pre-order customers informed of significant fulfillment updates using the contact information provided at checkout.
2. Pricing and Payment
Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, discounts, and promotions will be calculated or displayed during checkout.
Payment is collected when an order or pre-order is placed unless otherwise indicated at checkout.
We reserve the right to correct pricing or product-information errors and to cancel and refund an affected order when necessary.
3. Founding Batch Program
Purchases from the EYES UP Founding Batch help establish demand for our initial product order and support Last Call Initiative's distracted-driving prevention efforts.
Promotional offers associated with the Founding Batch, including free shipping or community-impact commitments, apply only as specifically described on the store at the time of purchase.
4. Community Impact
Last Call Initiative may use proceeds from EYES UP product sales to support its programs, operations, distracted-driving prevention activities, and distribution of safety products within the community.
References to community impact or providing additional products through our prevention efforts should not be interpreted as creating a charitable contribution or tax-deductible donation for the purchaser unless expressly stated otherwise.
5. Shipping and Delivery
Shipping rates, estimated transit times, pre-order fulfillment information, and other shipping conditions are governed by our Shipping Policy.
Delivery estimates are estimates only and are not guaranteed. Carrier delays and circumstances outside our reasonable control may affect delivery.
6. Cancellations, Returns and Refunds
Pre-order cancellations, returns, damaged products, and refunds are governed by our Return and Refund Policy.
7. Product Use
EYES UP products are intended to encourage safer, hands-free mobile-device use while driving. Customers are responsible for installing and using products appropriately and in accordance with applicable laws, vehicle requirements, device requirements, and manufacturer instructions.
No product eliminates the risks associated with distracted driving. Drivers remain responsible for operating their vehicles safely and maintaining attention to the road at all times.
8. Product Images and Information
We make reasonable efforts to accurately represent our products. Because Founding Batch products may be displayed using prototypes, samples, renderings, or pre-production imagery, the final product or packaging may have minor differences in appearance, specifications, or presentation.
We will not intentionally substitute a materially different product without appropriate notice.
9. Order Acceptance
We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including suspected fraud, payment issues, pricing errors, inventory limitations, or misuse of promotional offers.
If we cancel an order after payment has been collected, the applicable amount will be refunded.
10. Intellectual Property
EYES UP!, Last Call Initiative, associated branding, graphics, written content, and other original materials displayed through this store are owned by or used with permission by Last Call Initiative and may not be reproduced or commercially used without authorization.
11. Limitation of Liability
To the extent permitted by applicable law, Last Call Initiative will not be liable for indirect, incidental, special, or consequential damages arising from use of this store or its products.
Nothing in these Terms is intended to exclude or limit rights or remedies that cannot legally be excluded or limited.
12. Changes to These Terms
We may update these Terms of Service from time to time. Changes will apply prospectively when posted to the store. The terms applicable to a purchase are those in effect when the order is placed, except where a change is required by law.
13. Governing Law
These Terms are governed by applicable laws of the State of Texas and the United States, without limiting any consumer rights that may otherwise apply.
